The Challenge Committee for Arbitrators is one of the most relevant organs of the Court. Its function is to resolve incidents of recusal and substitution of members of the arbitral tribunal.

Composed of prestigious professionals

The Committee is composed of a majority of prestigious professionals from the legal world, totally independent of the Court of Arbitration of Madrid. The position is unremunarated.

Regulation

The Committee is regulated by the Statute of the Court of Arbitration of Madrid, as well as by the Internal Operating Rules approved by the Plenary of the Court.

The Committee is a collegiate body and is responsible for the challenge and replacement of arbitrators, with the support of the Secretariat of the Court.

The remaining members ("External Members") shall be persons of recognized prestige in the legal world external to the Chamber.

The Committee shall be composed of a minimum of four and a maximum of six members. The Committee shall be composed of a minimum of four and a maximum of six members. The President of the Court (“President”) shall be a permanent member of the Committee.

External Members shall be elected for two-year terms
External Members shall be elected for two-year terms, which may be extended for an additional year, and shall remain in office as members of the Committee until the date of the first Plenary Session of the Court following the expiration of the term (initial or extended) for which they were appointed. Once a term of office has expired, a minimum period of one year must elapse before they may be re-elected. Membership of the Committee shall be unremunerated.
They shall not be affected by any incompatibility
The members of the Challenge Committee shall not be affected by any incompatibility to act as arbitrators in Court proceedings.
